Nesquehon (“we”, “us”, or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and otherwise process personal information through the nesquehon.info website at nesquehon.info and the related software-as-a-service products, applications, and services (collectively, the “Service”). By accessing or using the Service, you acknowledge the practices described in this Privacy Policy, which is incorporated by reference into our Terms and Conditions and Terms of Service. If you do not agree with this Privacy Policy, you must not use the Service.
1. Information We Collect
We collect information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with you or your household. This includes identifiers such as your name, email address, postal address, telephone number, account credentials, and online identifiers; commercial information such as billing details, payment card information, transaction history, and subscription records; internet or other electronic network activity information, including IP address, browser type and language, operating system, referring/exit pages, pages viewed, clickstream data, and interactions with the Service; and inferences drawn from any of the foregoing to create a profile reflecting your preferences, characteristics, or behavior.
Some of the information we collect may be considered “sensitive personal information” under applicable state privacy laws, such as precise geolocation data, account log-in credentials, or financial account information, but only if and to the extent you voluntarily provide it or it is necessary to provide the Service. We may also collect audio, electronic, visual, or similar information if you contact customer support or participate in user research. We collect personal information directly from you, automatically through your use of the Service, and from third parties such as analytics providers, advertising partners, and identity-verification services.
We do not intentionally collect protected health information except where we have entered into a business associate agreement under the Health Insurance Portability and Accountability Act (HIPAA) or as otherwise required by law. Similarly, if you use a financial services feature offered by Nesquehon, any nonpublic personal information will be handled in accordance with the Gramm-Leach-Bliley Act, 15 U.S.C. §§ 6801-6809 (GLBA), to the extent applicable. For more information about the technologies we use to collect information automatically, please see our Cookie Policy.
2. How We Use Your Information
We use the personal information we collect for business and operational purposes, including to provide, maintain, secure, and improve the Service; process transactions, send billing notices, and provide account-related communications; communicate with you, respond to inquiries, and provide customer support; detect, prevent, and address fraud, abuse, security incidents, and technical issues; personalize your experience, deliver content and advertisements relevant to your interests, and measure the effectiveness of those advertisements; comply with applicable legal obligations, enforce our agreements, and protect our rights and the rights of others; and evaluate, develop, and improve our products, services, and marketing.
Where permitted by law, we may also use your information to send promotional communications about products, services, offers, and events. You may opt out of marketing emails by following the unsubscribe link in each message or by contacting us as described in Section 10. We do not use sensitive personal information for purposes other than those authorized under applicable state comprehensive privacy laws, including the California Consumer Privacy Act as amended by the CPRA (Cal. Civ. Code § 1798.100 et seq.), Virginia Consumer Data Protection Act (Va. Code § 59.1-575 et seq.), Colorado Privacy Act (C.R.S. § 6-1-1300 et seq.), Connecticut Data Privacy Act (Conn. Gen. Stat. § 42-515 et seq.), and Utah Consumer Privacy Act (Utah Code § 13-11-101 et seq.), as well as the comprehensive privacy laws of states such as Texas, Oregon, Montana, Florida, Tennessee, and others.
We may use aggregated, de-identified, or anonymized information for any lawful purpose, provided that we do not attempt to re-identify such information in a manner that would violate applicable law. We may also use personal information for purposes that are compatible with the context in which the information was collected or as otherwise disclosed to you at or before the time of collection.
3. Information Sharing
We do not sell personal information for monetary consideration. However, the California Consumer Privacy Act as amended by the CPRA defines “selling” and “sharing” personal information broadly and may include the disclosure of personal information to third parties for cross-context behavioral advertising or other valuable consideration. If we engage in such disclosures, you have the right to opt out by clicking “Do Not Sell or Share My Personal Information” where provided, by contacting us directly, or by using an opt-out preference signal such as the Global Privacy Control.
We may disclose personal information to service providers and contractors who perform services on our behalf, such as payment processing, data analytics, hosting, customer support, marketing, and fraud prevention, subject to written contracts that restrict their use to specified purposes and require appropriate security measures. We may also disclose information where required by law or legal process, to enforce our rights, to protect the safety, rights, or property of users or the public, or in connection with a business transaction such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
We may disclose personal information to our affiliates and business partners where you have requested or consented to such sharing. Other than as described in this Privacy Policy, we will not disclose your personal information to unaffiliated third parties without your consent except as permitted or required by law. We do not disclose personal information to third parties for their own direct marketing purposes without providing you the opportunity to opt out where required by law.
4. Cookies and Tracking
We and our service providers use cookies, web beacons, pixels, local storage, software development kits (SDKs), scripts, and similar technologies to collect information about your browser or device, your interactions with the Service, and your online activities over time and across third-party websites or services. These technologies help us operate the Service, analyze usage, remember preferences, authenticate users, and deliver and measure advertising.
We classify cookies and similar technologies into the following categories: (i) strictly necessary, which are required for the Service to function and generally cannot be disabled; (ii) functional, which support enhanced features and personalization; (iii) analytics and performance, which help us understand how visitors interact with the Service; and (iv) advertising and targeting, which are used to deliver relevant advertisements and measure their effectiveness. Session replay and similar analytics tools may be used subject to applicable state wiretapping and computer privacy statutes, including the Electronic Communications Privacy Act, 18 U.S.C. § 2511, and the California Invasion of Privacy Act § 631.
You may control cookies through your browser settings, device controls, and industry opt-out tools such as the Digital Advertising Alliance’s WebChoices and the Network Advertising Initiative’s opt-out page. California residents may opt out of the sale or sharing of personal information via the Global Privacy Control signal as required by Cal. Civ. Code §§ 1798.120 and 1798.135. Please note that disabling certain technologies may affect the functionality of the Service. For more details, please see our Cookie Policy.
5. Your Rights and Choices
5.1 US Consumer Rights
Depending on your state of residence, you may have rights under applicable state comprehensive privacy laws. These may include the right to know whether we process your personal information; the right to access, correct, or delete your personal information; the right to opt out of the sale or sharing of personal information and of targeted advertising; the right to limit the use or disclosure of sensitive personal information; the right to obtain a portable copy of your personal information; the right to appeal a denial of a consumer request; and the right not to receive discriminatory treatment for exercising these rights. The California Consumer Privacy Act as amended by the CPRA provides California residents with the rights to know, delete, correct, and opt out of the sale or sharing of personal information, as well as the right to limit use of sensitive personal information.
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Tennessee, and other states that have enacted comprehensive privacy laws may have similar or additional rights under the Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and corresponding state statutes. We honor opt-out preference signals such as the Global Privacy Control to the extent required by applicable law. Nothing in this section limits any other rights you may have under federal or state law.
5.2 Exercising Your Rights
To exercise any applicable right, please contact us using the information in Section 10. We will verify your identity before processing your request, which may require you to provide information sufficient to confirm your identity and, in some cases, a signed declaration under penalty of perjury. You may designate an authorized agent to make a request on your behalf by providing written permission and verifying your identity. We will respond within the timeframes required by applicable law, generally forty-five (45) days with one extension when reasonably necessary.
If you are a resident of a state that provides a right to appeal and we deny your request, you may appeal the denial by contacting us at [email protected]. We will respond to your appeal within the timeframe required by applicable law. We do not charge a fee to process or respond to verifiable consumer requests unless permitted by law. If we cannot verify your identity or authority to act on your behalf, we may be unable to fulfill your request.
6. Data Security
We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, disclosure, or destruction. These measures include encryption of data in transit and at rest where appropriate, access controls and authentication requirements, regular security assessments, penetration testing, and incident response procedures. We restrict access to personal information to employees, contractors, and service providers who need to know the information to operate, develop, or improve the Service and who are subject to confidentiality obligations.
Despite our efforts, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. To the maximum extent permitted by applicable law, Nesquehon shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to unauthorized access to, alteration of, or destruction of personal information, regardless of the legal theory, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to this Privacy Policy shall be limited to the amount you paid to us, if any, for the Service in the twelve (12) months preceding the claim.
In the event of a data breach involving personal information, we will comply with applicable federal and state breach notification laws and will notify affected individuals and regulators as required by law. We also maintain a written incident response plan and will take reasonable steps to mitigate the effects of any security incident.
7. International Data Transfers
Nesquehon is based in the United States, and the personal information we collect is processed and stored in the United States. If you access the Service from outside the United States, you consent to the transfer of your information to the United States, which may have data protection laws that differ from those in your jurisdiction. The United States does not have a federal omnibus privacy statute comparable to those in some other jurisdictions; instead, privacy obligations depend on sectoral laws such as COPPA, HIPAA, and GLBA, enforcement under the Federal Trade Commission Act § 5, 15 U.S.C. § 45, and the rapidly evolving patchwork of state comprehensive privacy laws.
We do not transfer personal information to jurisdictions outside the United States for processing except as necessary to provide the Service, to comply with law, or with appropriate contractual and organizational safeguards. If we transfer personal information to a third party located outside the United States, we require that the recipient maintain appropriate safeguards and process the information only for the purposes described in this Privacy Policy. We do not rely on the laws of any foreign jurisdiction to override the protections described herein.
8. Children's Privacy
The Service is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen in violation of the Children's Online Privacy Protection Act, 15 U.S.C. §§ 6501-6506 (COPPA), and the COPPA Rule as amended effective June 2025 (16 C.F.R. Part 312, 2025 amendments). If we learn that we have collected personal information from a child under thirteen without verifiable parental consent, we will take steps to delete that information as soon as possible and will not use it for any purpose.
If you are a parent or guardian and believe that your child under thirteen has provided personal information to us, please contact us immediately at [email protected]. We may collect information from users between the ages of thirteen and seventeen only with appropriate consent and in compliance with applicable state laws. We encourage parents and guardians to monitor their children’s online activities and to consider using parental control tools available from online services and software manufacturers.
9. Changes to Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or business operations. When we make material changes, we will post the revised Privacy Policy on this page and update the “Last Updated” date at the top of the page. We may also provide additional notice, such as by email or through a prominent notice on the Service, if required by law or if the changes are material. You are advised to review this Privacy Policy periodically for any changes.
Your continued use of the Service after the effective date of any revised Privacy Policy constitutes your acceptance of the revised terms. If you do not agree to the revised Privacy Policy, you must stop using the Service and may request deletion of your account and personal information
